With the Texas Gun and Knife Show coming back to Abilene in August, you may have some firearms you would like to buy or sell. While all Texas gun laws do not apply directly to gun sales between two individuals, there are some Texas laws written specifically for you and me when it comes to buying or selling a firearm between individuals.

Here's how to sell your firearms legally and safely in Abilene and throughout Texas, in light of the Supreme Court’s latest ruling about the Court’s new domestic-abuse felons and the laws placing a heavier responsibility on the sellers in one of the most lenient states: Texas, of course!

Understanding the Texas gun laws for individuals wanting to buy or sell their own firearms in Texas is pretty simple. The Texas State gun laws of 2024 for responsible gun owners are entirely different from the laws that licensed dealers have to abide by.

What Texas Gun Laws Must Individuals Selling Their Personal Guns Abide By?

  • Constitutional Carry: As of September 1, 2021, Texas residents can carry handguns openly or concealed without a license, known as Constitutional Carry.
  • Private Sales: Private gun sales between individuals are legal without requiring background checks. However, sellers must adhere to specific guidelines to ensure compliance.
  • Seller’s Liability: While background checks aren’t mandatory for private sales, sellers must not knowingly sell to prohibited individuals. This includes convicted felons, those under 18 (with some exceptions), and individuals with mental health conditions.
  • Due Diligence: Sellers should exercise caution and use reasonable judgment. If there are any red flags or suspicions about a buyer’s eligibility, it’s best to refrain from the sale.
  • Bill of Sale: While not required, creating a bill of sale is highly recommended. It serves as a record of the transaction, documenting the buyer’s and seller’s information, firearm details, and date of sale. This protects both parties if legal issues arise.

Is It A Good Idea To Go Through A Licensed Dealer?
