This is a follow up to my earlier post today on the Mexican national Humberto Leal. He was put to death this evening following a hard fought stay of execution.  This controversial case even had the White House calling for the state of Texas to stay the execution.

Humberto Leal was pronounced dead at 6:21pm Thursday evening.  Both the U.S. Supreme Court and Texas Governor Rick Perry denied Leal's defense team a stay of execution.

The State Department, President Obama and Mexican authorities had all asked for Texas authorities to stop the execution because Leal was not granted access to the Mexican consulate during his trial.  Which, by the way, was in 1995 when Leal was sentenced to death for raping and killing a 16 year old girl.

The above mentioned authorities had asked for the reprisal on the bases of the 1963 Vienna Treaty that required foreign nationals arrested in foreign countries access to their respective consulates.

The decision by the court was delivered about an hour before the execution.

In a 5-4 decision an hour before the execution, the majority wrote, “We have no authority to stay an execution in light of an 'appeal of the President,' presenting free-ranging assertions of foreign policy consequences, when those assertions come unaccompanied by a persuasive legal claim.”

The Bexar County DA defends Texas' position in the case by stating that the outcome of this case would not have been any different had Leal received assistance from the Mexican consulate and that one court had already heard his argument once before and did not agree.  He has been in the states since he was 2 years old and was by all accounts a US citizen more than a Mexican citizen.

The DA goes on to say that over the last 17 years Leals team has presented his case to the U.S. Supreme court, federal courts,Texas Supreme court, court of criminal appeals and none granted him any kind of reprisal.


Leal was guilty of this crime and he paid the price. The family of the victim can hopefully have closer now in knowing that this man is gone and will never again hurt anyone else.
